can i return a fake ps3 controller on ebay (if it is fake/not sure if it is?)?

i bought a ps3 controller for about $47AU on ebay and i recently received it, and the buttons are not reliable as sometimes i press it and it doesnt communicate it to the ps3, also the plastic manufacturing is a little tacky, and the buttons feel alot different to the original ones i have, also the weight is alot more.

i have already opened it from the box that it was in, when sent to me via ebay.
Can i ask for a refund if i return the item? i have another of the same product coming in the post, can i return that one that is still in box? \

QUESTION: IS IT FAKE, AND CAN I RETURN EACH OF THEM?

It's probably not fake but it's probably a "Hong Kong Special". They manufacture really cheap products that aren't worth buying.
