Default PS3 Controller messing up, but not really?

Okay, so whenever I play Call of Duty: MW3, my second player messes up. It is not really affecting my game play, it only messes up on the choose your weapon screen, like it keeps scrolling down, even though nothing is being touched. At first I thought it was my controller(s), because it was happening with both. But I bought a brand new sony controller and it is still doing the same thing.
I do have a warranty, but is there a simple solution. Or is anyone else having this issue.

Also it only messes up sometimes, like 75% of the time, but always after using it for like 5 games.

If its scrolling down, make sure the analog stick isn't sticking
